واقع حقوق ذوي الإعاقة في الشريعة الإسلامية والتشريعات الفلسطينية ومدى تطبيقها

تهدف هذه الدراسة إلى تحليل مدى تطبيق التشريعات الفلسطينية الخاصة بحقوق الأشخاص ذوي الإعاقة ومدى توافقها مع الاتفاقيات الدولية، إضافةً إلى دراسة هذه الحقوق من منظور الشريعة الإسلامية. اعتمدت الدراسة على المنهج الوصفي التحليلي، حيث تم جمع البيانات باستخدام استبانة وزعت على عينة مكونة من (300) مشارك من الأشخاص ذوي الإعاقة، المسؤولين الحكوميين، وممثلي منظمات المجتمع المدني. وأظهرت النتائج أن التشريعات الفلسطينية تكفل عددًا من الحقوق الأساسية، مثل التعليم الدامج، التوظيف، والرعاية الصحية، إلا أن التطبيق الفعلي لهذه القوانين يواجه تحديات كبيرة، من بينها نقص التمويل الحكومي، ضعف الرقابة، وعدم توفر البنية التحتية الملائمة. كما كشفت نتائج تحليل التباين الأحادي (ANOVA) وجود فروق ذات دلالة إحصائية في مدى تطبيق التشريعات تعود إلى العوامل المؤسسية، حيث تبين أن المؤسسات الدولية تطبق القوانين بشكل أكثر كفاءة مقارنة بالمؤسسات الحكومية والأهلية. ومن منظور الشريعة الإسلامية، تؤكد التعاليم الإسلامية على وجوب احترام حقوق الأشخاص ذوي الإعاقة، وتكفل لهم الحماية الاجتماعية والاقتصادية، مستندة إلى مبادئ العدل والمساواة والتكافل الاجتماعي. كما تحث الشريعة على تهيئة بيئة مناسبة لهم تمكنهم من ممارسة حقوقهم دون تمييز. وبناءً على هذه النتائج، توصي الدراسة بضرورة تعزيز آليات الرقابة، زيادة التمويل الحكومي، وتحسين التنسيق بين الجهات المختلفة لضمان تطبيق أكثر فعالية لهذه التشريعات، مع التركيز على إدماج القيم الإسلامية الداعمة لحقوق ذوي الإعاقة ضمن السياسات والتشريعات المعمول بها.
