The Reality of the Rights of People with Disabilities in Islamic Sharia and Palestinian Legislations and the Extent of their Implementation

The study aims to analyze the extent of implementing the special Palestinian legislation on the rights of people with disabilities and its alignment with international agreements, as well as to study these rights from an Islamic perspective. The study employed the descriptive-analytical approach where a questionnaire was used to collect data and was distributed to 300 participants (people with disabilities, officials, and civil society representatives). The research found that the Palestinian legislation guarantees key rights such as inclusive education, employment and healthcare. However, implementation of these rights faces major challenges, including limited funding, weak oversight, and poor infrastructure. ANOVA results showed significant differences in legislative enforcement across institutions, with international bodies performing better than governmental and non-governmental ones. From an Islamic perspective, the islamic teachings stress on respecting the rights of people with disabilities, and ensure social and economic protection relying on principles of justice, equality, and social solidarity. The Islamic Sharia urges creating an environment that enables them to practice their rights with no discrimination. Based on these results, the study recommends strengthening oversight, boosting government funding, and enhancing institutional coordination among different authorities to ensure more effective implementation for these legislations, with more focus on embedding supportive Islamic principles for the rights of people with disabilities into applicable policies and legislations
